Widows/Widower's Allowance

If a spouse dies in Michigan, the surviving spouse has certain allowances (payments) before there is a distribution to the beneficiaries. As of 2014, the allowances include:

Homestead Allowance $22,000

Exempt Property $14,000

Family Allowance $262,000 (maximum lump sum without court order)

The above payments have priority over creditors and beneficiaries under a Will or to the Heirs if there is no Will (Intestacy)
